State, and county and local agencies within New York State.  Civil Service laws
provide specific rights to individuals who believe they have experienced any
of the following:

  • Unlawful Termination
  • Passed Over for Appointment to a Civil Service Position
  • Failure of a drug test or other aspect of background check
  • Denied or Passed over for Promotion or Assignment

The law provides opportunities to appeal these decisions.  However, the
deadlines for initiating legal action to reverse these decisions are very short.  
In most cases, legal action must be initiated within 120 days of the adverse
